Terms of Service

By accessing or using Kovu (the “Service”), provided by Leonenko Group LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Kovu provides software and a hosted account platform that allows users to organize, manage, and stream personal media libraries from servers they own and operate. Kovu does not provide, host, or distribute any media content. All media files remain on the user’s own hardware and networks.

Kovu is designed exclusively for personal media libraries consisting of content you legally own, have purchased, or are otherwise licensed to access.

By using Kovu, you represent and warrant that all media content accessed through this service is legally obtained and that you hold the necessary rights or licenses to stream such content.

Kovu does not host, store, distribute, or transmit any third-party copyrighted content. All media files remain on your own servers and devices.

We have zero tolerance for copyright infringement. Any use of Kovu to stream, distribute, or access pirated, unlicensed, or illegally obtained content is strictly prohibited and constitutes a material breach of these Terms.

Kovu complies with the Digital Millennium Copyright Act (DMCA). Copyright holders may submit takedown notices to legal@kovu.tv.

To use certain features of Kovu, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized account use.

You must be at least 13 years old to create a Kovu account.

Kovu offers a Free plan and a paid Pro plan. The Free plan permits up to one server and two profiles. The Pro plan, billed at $4.99 per month, removes those limits and unlocks additional features.

Pro subscriptions renew automatically each billing period until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods.

Pricing and features may change. We will provide notice of material changes that affect existing subscribers.

Your use of Kovu is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Kovu and all related software, branding, designs, and trademarks are the property of Leonenko Group LLC. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain all rights to media content you provide or access through Kovu. You grant us only the rights necessary to operate the Service on your behalf (such as storing account metadata).

You agree not to:

• Use Kovu to access, stream, or distribute pirated or unlicensed content;
• Violate any law, regulation, or third-party right;
• Reverse engineer, decompile, or attempt to extract source code from Kovu, except as expressly permitted by law;
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure;
• Use the Service to harass, abuse, or harm any person;
• Resell, sublicense, or commercially exploit the Service without our written consent.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, LEONENKO GROUP LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or used the Service for unlawful purposes, including the distribution of infringing content. Upon termination, your right to access the Service ceases immediately.

You may delete your account at any time from your account settings.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
